SPEEDWAY LICENSE TERMS AND CONDITIONS
For
ALL AUTOBAHN INDOOR SPEEDWAY LOCATIONS and ACCELERATE INDOOR SPEEDWAY LOCATIONS

The following Speedway License Terms and Conditions apply to the purchase, use or acceptance of an Autobahn Indoor Speedway License or Accelerate Indoor Speedway License, and constitute an agreement (the “Agreement”). Terms and Conditions apply to all Speedway Licenses activated at the Accelerate Indoor Speedway location, and at any Autobahn Indoor Speed locations (collectively, “AIS”). Purchase, use or acceptance of a Speedway License constitutes acceptance of this Agreement, and acceptance of our Website Terms of Use , our Privacy Policy and any other Terms and Conditions that may apply to the Speedway License as determined by AIS from time to time.

About Your Speedway License – In General

All racers must maintain an active Speedway License in order to race at any location. Minimum Age and Height requirements must be met by each racer activating a License and all License fees must be paid in to maintain an active Speedway License.  Safety Rules must be followed by all racers with an active License.  A Speedway License may be revoked at any time at the sole discretion of AIS and a refund may not be issued.

An active Speedway License must be presented or purchased by racer prior to being scheduled into a race. AIS reserves the right to refuse to accept or otherwise limit the use of any Speedway License if we reasonably believe the use is unauthorized or unlawful or otherwise at our sole discretion.

Your Speedway License is not transferrable and must be renewed upon each expiration for a separate fee.  Your Speedway License is valid for your initial race experience and for the time period indicated by the Speedway License package you purchase, if any.

Racers must follow all Safety Rules and meet Minimum Age and Height Requirements at all times in order to maintain racing privileges and an active License.  If your Speedway License expires, simply come to one of our locations and we will renew your License for a small fee and according to your Speedway License package terms.  Speedway License fees may vary depending on your racing location and the Speedway License package purchased.  To determine your Speedway License fee please call or visit your local race track.  For a list of Autobahn Indoor Speedway and Accelerate Indoor Speedway locations, click here.

Your Speedway License is not redeemable for cash except as required by law and does not have any cash value. The Speedway License may not be resold and is for individual use only. The Speedway License is not a gift card, credit or debit card, and no credit card, overdraft protection, deposit account, or depository insurance is associated with it and there is no cash value.

The Speedway License is not an official license and does not confer any benefits or rights when not active.  An active Speedway License only grants racer a temporary right to be scheduled into a race by AIS.  No other rights, promises, indemnifications, benefits or other options are conferred to racer by AIS.

Speedway License fees are not refundable, unless required by law, so please read our and Safety Rules in addition to Minimum Age and Height Requirements carefully to make sure you are eligible to race at our locations.

Activation or Renewal of Your License

To activate, renew or check the status of your Speedway License just call or visit the nearest Autobahn Indoor Speedway or Accelerate Indoor Speedway track location during operating hours. Your current Speedway License can be renewed and does not require a new plastic card upon each renewal so safeguard your card as it can be reused.  AIS reserves the right to revoke a Speedway License at any time and at its sole discretion.  Refunds may not be given for a Speedway License that is revoked.

Replacement of License

You are responsible for your Speedway License.  A Speedway License which has been lost, stolen, damaged, or otherwise rendered unreadable may not be replaced, so please safeguard your License.

Unused Races

Unused races are not refundable and are not transferable.

Minimum Age and Height Requirements

  • Junior kart racers must be at least 48″ tall and 8 years old.
  • Pro Kart racers must be at least 56″ tall, at least 13 years old.
  • All kart racers must weigh less than 300 lbs.
  • All racers must also be able to wear a helmet (which we provide) and fit in the kart seat.
  • Closed toe shoes are required (we have loaners and fresh socks if you need them).
  • Racers under 18 must be accompanied by the parent on their first visit or the child must bring THIS WAIVER  signed by a parent along with a photocopy of the parent’s driver’s License.
  • Racers 18 and older must complete a waiver to race.
  • Do not race if you have any medical conditions including seizures, or heart or back issues. Consult your doctor if you are unsure if it is safe for you to race.
  • AIS in its sole discretion reserves the right to determine whether a racer meets minimum requirements and is competent and able to race.

Safety Rules

On our tracks you will be experiencing real racing (not an amusement ride).  DO NOT RACE if you are pregnant, or have medical issues including neck, back or heart problems.  It is very important that you pay attention to the flags and the Safety Rules to avoid accidents.

  • Minimum Height Requirements for Racers is 48” for Junior Karts and 56” for Pro Karts.
  • Racers must watch the safety video before racing.  If you have any questions about the safety video, please ask the staff.
  • Anyone under the influence of alcohol or drugs will not be allowed to race-no exceptions.
  • Helmets must be worn while in Kart.  We will provide you with a helmet, race mask and optional neck protector.
  • For your safety long hair must be pulled back into a ponytail and open toe shoes are not allowed while racing.
  • Crashing or Bumping into Karts or barriers, or ‘blocking’ of other Karts is not allowed (even while attempting to pass).  The speed on an offender’s Kart will be reduced on or more laps. RACERS MUST COMPLY WITH INSTRUCTIONS FROM THE RACE MARSHALL AND PIT CREW. Repeat offenders may be ejected with no refund.
  • Do not press the gas pedal and brake pedal at the same time.  This will cause your Kart to shut down.
  • After your race, stay in your Kart until you are told that you may get up.

Resolution of Disputes / Limitations on Liability and Damages

Please read this entire section carefully. It requires binding arbitration of most disputes instead of litigation in court, and affects legal rights that you may otherwise have.

Arbitration Rights / Class Action and Jury Trial Waiver

Any claim, controversy, or dispute arising out of or relating to your use of the Speedway License or this Agreement – whether based in contract, tort, statute, or other legal theory – shall be resolved by binding arbitration in accordance with the arbitration procedures set forth below, except that we or you may pursue relief in small claims court if the dispute falls within the applicable small claims court’s jurisdiction, and we or you may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

We and you both hereby waive the right to pursue any claim arising out of or relating to your activation and use of the Speedway License or this Agreement on a class action, consolidated, representative, or private attorney general basis, whether in arbitration or in court. We and you also hereby waive the right to a jury trial.

Arbitration Procedures

Any arbitration in connection with this Agreement shall be conducted by the American Arbitration Association (the “AAA”), in accordance with its Consumer Arbitration Rules (the “AAA Rules.”). The AAA Rules and information about the arbitration process are available at www.adr.org or by calling 1-800-778-7879.

If you wish to initiate an arbitration proceeding, you must send a letter describing your claim to Autobahn Holdings, LLC’s registered agent, Speedway Management, Inc. 9149 Highland Ridge Way, Tampa, FL 33647.  The letter must briefly explain the dispute, list the names and addresses of both you and the business(es) involved in the dispute, specify the amount of money in dispute if any, identify the requested location for the arbitration hearing if you wish to have an in-person hearing, and state what you are seeking in terms of relief. You must also either send a copy of the letter to the American Arbitration Association, Case Filing Services, 1101 Laurel Oak Road, Suite 100, Voorhees, NJ 08043, or file it online using the AAA’s WebFile system, which may be accessed through www.adr.org.

The arbitration will take place in the county in which you reside and will be decided by a single arbitrator, unless the parties agree otherwise. The arbitrator will have the power to award you, on an individual basis, the same damages and other relief that a court can award under this Agreement and applicable law.

For claims of less than $1,000, we will be responsible for paying all administrative fees and costs. Otherwise, the payment of all administrative fees and costs will be governed by the AAA Rules. Reasonable attorneys’ fees and related expenses may be awarded only to the extent permitted under applicable law.

The arbitration award will be subject to limited court review, and judgment on the award may be entered in any court having proper jurisdiction. The arbitration shall be confidential, and neither we nor you may disclose the existence, content, or results thereof, except for purposes of enforcement of any arbitration award or otherwise required by law.

Limitations of Liability and Damages

We make no warranties, express or implied, with respect to the Speedway License, including but not limited to any implied warranty of merchantability or fitness for a particular purpose. In the event that your License is lost, stolen, damaged, or otherwise rendered non-functional, your sole remedy, and our sole liability, shall be the replacement of such License in accordance with the terms set forth above.

We and you agree that, on any claim arising out of or relating to your use of Speedway License or this Agreement, recovery of damages shall be limited to actual and direct damages, and may not include any indirect, special, consequential, enhanced, or punitive damages. We and you both hereby waive the right to seek or recover any indirect, special, consequential, enhanced, or punitive damages.

Note: In some states, the law does not permit limitations on implied warranties or the limitation or exclusion of certain types of damages. If those laws are applicable to you, some or all of the foregoing limitations and waivers may not apply to you. In that event, the limitations and waivers shall be applicable to the fullest extent permitted by law.

Extension to Related Entities / Persons and Survival

The foregoing arbitration provision, limitations, and waivers are intended to be construed broadly, and shall apply to any and all claims arising out of or relating to your use of the Speedway License or this Agreement, against any entity or person affiliated with AIS, including but not limited to Autobahn Holdings, LLC and any Autobahn Indoor Speedway location or Accelerate Indoor Speedway location in the U.S. and any of their respective directors, officers, employees, or other representatives.

The foregoing arbitration provision, limitations, and waivers shall also survive the termination of this Agreement.

In the event that any part of this Agreement is determined by an arbitrator or court to be invalid or unenforceable, the remainder shall still be given full force and effect, to the fullest extent permitted by law.

Governing Law

We and you agree that your use of the Speedway License, and this Agreement, evidence transactions affecting interstate commerce, which render this Agreement subject to the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq.

This Agreement shall otherwise be governed by and construed in accordance with the substantive laws of the State of Florida, without reference to any rules regarding conflicts of law.

Effective Date / Changes to Terms and Conditions

These Speedway License Terms and Conditions are effective upon publication on this website. You should not activate or renew your Speedway License if you object to this Agreement. Activation or renewal of the Speedway License constitutes acceptance of this Agreement.

We reserve the right to modify or terminate the Speedway License Terms and Conditions, at any time, by posting notice of such modifications on this website.
